EUIPO Boards of Appeal in the Light of the Principle of Fair Trial

The EUIPO’s Boards of Appeal are called upon to decide on appeals against decisions by the bodies of ‘first instance’. However, their judicial function has always been denied. Conversely, the essay tends to place the Boards of Appeal of the EUIPO in any case within the concept of ‘court’, as defined by the ECtHR, within the framework of Article 6 ECtHR, because it assesses their independence, impartiality, and in general the guarantees required by the ‘fair trial’, until concluding that it is a paradigmatic model in the overall administration and judicial system. The Eurosceptic turnabout which has taken place in the CEE constitutes one of the most significant factors weakening the cohesion of the EU. In this group, Poland is the key element in view of its size and the status of the ‘poster boy’ of Europeanization acquired in the previous years. This paper analyses the major trends in the European policy of the Polish governments in the long-term period of 1990–2018 on the basis of standardized data (addresses by the Polish ministers of foreign affairs) and a quantitative analysis. Policies adopted by the governance of the EMU during the financial and Covid crises display a clear gap between the “form” and the “substance” of the institutional architecture of title VIII of the TFEU. It is submitted that this architecture is in sharp contrast with the European constitutional tradition. Furthermore, the traditional view is rejected, according to which the EU Commission and Council, as well as the ECB, are devoid of binding powers in the field of economic policy. Does EU cohesion policy work? Theory and evidence

This paper evaluates the effectiveness of European Cohesion Policy in the regions of 12 EU countries in the period 1991–2008, on the basis of a spatial growth model, which allows for the identification of both direct and indirect effects of EU funds on GDP per worker growth. We find that “Objective 1” funds are characterized by strong spatial externalities and a positive and concave effect on the growth of GDP per worker, which reaches a peak at the ratio funds/GDP of approximately 3 percent and becomes non-significant after 4 percent. “Objective 2” and “Cohesion” funds have nonsignificant effects, while all the other funds exert a positive and significant effect, but their size is very lim…

THIS PAPER AIMS TO SHOW HOW EU-INTEGRATION OF THE CENTRAL AND ORIENTAL EUROPEAN COUNTRIES WOULD MODIFY THE GROWTH OF EUROPEAN REGIONS. WE DEMONSTRATE THAT « NEW ECONOMIC GEOGRAPHY » AND « NEW GROWTH THEORIES » TOGETHER ARE WELL SUITED TO UNDERSTAND AND EXPLAIN VARIOUS PHENOMENA ASSOCIATED WITH EUROPEAN INTEGRATION POLICIES. WE SHOW THAT THESE POLICIES WILL BE PROFITABLE TO GROWTH BUT WILL REINFORCE THE UROPEAN CORE-PERIPHERY GEOGRAPHIC PATTERN. WE ALSO SHOW THAT SOME MECANISMS COULD COUNTERACT THIS PATTERN OF UNEVEN DEVELOPMENT.
